Terms & conditions
The basis on which we accept, carry, clear and deliver your cargo. Last updated September 2026.
1. Who these terms apply to
These terms govern all services provided by FasFas Express Inc. (“we”, “us”), including container shipping, consolidated cargo shipping, customs clearing and delivery within Liberia. By booking with us, or by delivering cargo into our care, you (“the customer”) accept these terms.
2. Quotations and payment
- Quotations are valid for [30] days from the date issued and are based on the information you give us.
- If the actual cargo differs in size, weight, contents or destination from what you described, the price will be recalculated and confirmed to you before the cargo is shipped.
- Freight charges are payable [before the container is loaded / before sailing]. Duties, taxes, port charges and delivery are payable [before release of the cargo in Liberia].
- Government duties, taxes and statutory fees are set by the authorities, not by us, and are charged to you at cost.
- Cargo will not be released until all sums due have been paid in full.
3. Your responsibilities
- Accurate declaration. You must describe the contents and value of your cargo truthfully and completely. You are responsible for any fine, penalty, seizure, delay or loss arising from an inaccurate or incomplete declaration.
- Packing. You must pack cargo so that it can withstand normal handling and sea transport. We are not liable for damage caused by inadequate packing.
- Prohibited items. You must not include any item listed on our prohibited items list or otherwise restricted by law at origin, in transit or in Liberia.
- Documents. You must supply the documents we request, accurately and on time. Delays caused by missing documents are at your cost.
- Consignee details. You must provide a correct consignee name, identification details and a contactable phone number.
4. Acceptance, inspection and refusal
We may open, inspect, x-ray, weigh or re-pack any cargo, and we may refuse or return any cargo that is prohibited, unsafe, incorrectly declared or unsuitable for carriage. Customs and port authorities may also inspect cargo at any time; we will attend such inspections where we are the clearing agent.
5. Transit times
All sailing dates, arrival dates and delivery windows are estimates given in good faith. They are not guaranteed and do not form part of the contract. Sea freight schedules are controlled by the carriers and are affected by transshipment, weather, port congestion and customs processes outside our control.
6. Customs clearing
Where we act as your clearing agent, we do so on your written authority and on your behalf. Duty and tax assessments are made by the Liberia Revenue Authority. Any estimate we give of duties or charges is an estimate only. We will not lodge a declaration we believe to be false.
7. Storage and demurrage
Cargo held at our warehouse beyond the agreed free period of [__] days is charged storage at our published daily rate. Demurrage, detention and port storage charged by carriers or the port authority are passed on to you at cost. These charges accrue daily and are your responsibility.
8. Delivery
- We deliver to the address you nominate and release cargo only to the named consignee on production of valid photo identification, or to a person that consignee authorises in writing.
- Delivery is to ground level at the address. Access must be safe and suitable for our vehicle.
- If delivery cannot be completed because the consignee is unavailable, unreachable or refuses the cargo, storage charges and a further delivery charge apply.
- A signature on delivery is evidence that the stated number of pieces was received in apparent good order.
9. Liability
Our liability for loss of or damage to cargo is limited to [the lesser of the declared value of the affected item or the applicable carrier limitation], and in any event does not exceed [__]. We are not liable for:
- indirect or consequential loss, including loss of profit, business or opportunity;
- damage arising from inadequate packing, inherent defect, or the nature of the goods;
- delay, however caused;
- loss or damage caused by customs, port or government action;
- cargo that you failed to declare, or that is prohibited.
Nothing in these terms excludes liability that cannot lawfully be excluded.
10. Insurance
Basic carrier liability is limited and is not insurance. Marine cargo insurance is available on request and must be arranged before the cargo sails, based on a declared value. If you decline insurance, you carry the risk.
11. Claims
Any claim for loss or damage must be notified to us in writing within [7] days of delivery, with photographs of the packaging and contents and a copy of the intake receipt and packing list. Claims notified after that period cannot be considered. Claims are not accepted while any amount remains outstanding on the shipment.
12. Unclaimed cargo
Cargo that remains unclaimed or unpaid for more than [90] days after arrival may be sold or disposed of to recover the amounts owed, after we have given written notice to the customer at the contact details we hold.
13. Governing law
These terms are governed by the laws of [the Republic of Liberia / South Australia], and the courts of [__] have exclusive jurisdiction.
14. Changes
We may update these terms. The version in force is the one published on this page on the date your booking is confirmed.
